Article 1. Registration
1.1 By registering, the participant agrees to the following conditions of GetAbroad S.L.
Article 2. Selection and placement
2.1 GetAbroad will always do its utmost to comply with the specified departure date preference. However it is often the case that short notice changes are made by either the resort, operator, or sometimes carrier. We advise some flexability.
2.2 GetAbroad selects the participant based on the known capacities and skills for the task to be performed, and also on the information provided to GetAbroad by the foreign/resort employer. This also extends to the facilities offered.
2.3 In the event of insurmountable difficulties between the participant and the foreign employer during the trial period (1 or 2 months depending on the client) GetAbroad will do its utmost to find another placement for the participant.
However, GetAbroad can never guarantee this. After the agreed trial period, the participant is ‘definitive’ with the foreign employer. The participant can no longer address GetAbroad in the event of insurmountable difficulties at the destination. These must then be brought to the attention of the local employer and resolved locally.
2.4 In the event of a problem or complaint during the trial period (1 month), the participant is to report this immediately to the coordinator and also the local employer on the ground. If the complaint is not resolved satisfactorily, the participant must immediately contact GetAbroad by telephone or by email so that GetAbroad can resolve the situation. If this does not happen GetAbroad cannot accept any responsibility.
2.5 The participant understands that the commission of any crime or criminal conduct whilst in placement or employed would be grounds for the immediate termination of any agreement. GetAbroad reserves the right to terminate your employment under such conditions.
2.6 The participant must be flexible regarding the position and placement on location. Where possible, GetAbroad will of course do its best to adhere to the participant’s preferences.
2.7 If the foreign employer reports that it considers the participant suitable, a direct employment agreement between the participant and the foreign employer may be entered into. If this happens then the relationship with GetAbroad is terminated.
2.8 GetAbroad and/or the foreign employer reserve the right to terminate any employment contract if it appears that the placement is the result of false, or misleading, information provided by the participant regarding availability, work experience, criminal history, drug/alcohol use and/or misstatement of experience and/or knowledge of foreign languages.
2.9 If an employment contract is dissolved within the trial period, the participant does not appear to comply or is subsequently immediately dismissed on justified grounds, or decides to end the work, the participant will pay the travel costs to and from the work environment.
2.10 GetAbroad reserves the right to dissolve the agreement if it appears that the participant does not pass the selection after three assessments. And/or if the participant does not comply with the requested by GetAbroad of an interview with a foreign employer or participating in any required Casting that GetAbroad considers essential for placing the participant.
2.11 If the participant decides to stop earlier than the pre-agreed contract period, there is no right to a refund of any paid program costs. The employer can therefore withhold a percentage of the wages for the inconvenience and additional costs caused in looking for a new candidate.
Article 3. Payment program costs/placement costs
3.1 If the participant accepts the placement contract, he/she must transfer the program costs/placement costs of EUR 387.20 to Account number ES50 0081 0240 1800 0346 5457 Bic: BSABESBB for the attention of Getabroad S.L. , within 8 days of the invoice date, stating the invoice number.
3.2 If the participant departs within 8 days, the program costs/placement costs must be transferred to GetAbroad’s account before departure by means of a telephone transfer. The placement of the participant will only be final after receipt of the program costs/placement costs. If the program costs/placement costs are not received in time, the placement and therefore the job will expire.
3.3 If the program costs/placement costs owed are not paid within 8 days of the invoice date, the placement contract and thereby the guarantee on a job abroad will lapse.
3.4 The participant can take out cancellation insurance for the program costs, for example with Isis Insurance.
Article 4 Force majeure
4.1 Shortcomings in the fulfilment of the agreement by the foreign employer cannot be attributed to GetAbroad if they are not its fault.
4.2 GetAbroad cannot be responsible for any failure to deliver as a result of war, mobilization, riots, flooding, lack of coal, Covid or other epidemics, supply issues relating to gas, petroleum or other means of energy generation, fire and other accidents, strikes, lock-outs actions by trade unions, other government measures, non-delivery of materials by third parties, intent or fault of auxiliary persons and other similar circumstances, are regarded as not attributable to GetAbroad and do not entitle the participant to any compensation.
Article 5. Liability
5.1 The liability of GetAbroad and any damage for which GetAbroad can be held liable is expressly limited to a maximum of the amount of the program/placement costs charged 320 euros.
5.2 GetAbroad is never liable for (travel) costs incurred, loss of income or immaterial damage of any nature whatsoever, by the participant/star or by the client.
5.3 GetAbroad does not accept any liability and/or indemnification for liability based on accidents that affect the accepted participant when travelling to and from the workplace and the performance of his/her work or leisure time there, or damage caused by the candidate to the work environment and/or third parties.
Article 6.
6.1 The participant must be physically and mentally healthy. Some employers ask for a medical certificate from the participant.
Article 7.
7.1 The participant must be aware that there may be a difference in the payments paid or paid between the participants from different countries in the workplace. The participant should be aware that there may be a difference between participants from different countries in terms of program fees/placement fees paid.
Article 8.
8.1 A stay abroad means different people and different habits, a different culture, a different climate and different rules. In other words: different from home. This is one of the most attractive aspects of working abroad, but it is also an aspect to consider in anticipation and expectations. We, therefore, ask our participants for the necessary flexibility when circumstances deviate from the situation in their home country.’ When in Rome’
